GENERAL TERMS
The following Terms of Service ("TOS") are between the User and 炎上悪魔 (The manager of Vyro Virtual Singers) and contains an agreement that governs the use of the sound source library (referred to as "voicebank") for the Vocal Synthesizing programs such as UTAU, OpenUTAU, RVC and many more open sourced Vocal Synthesizers. "炎上悪魔" is defined as the author of Vyro Virtual Singers and the Setsuen Arashi (嵐雪炎) and Feng Zhaoming (照明风) voice libraries. The User must read the TOS and agree to it before downloading or purchasing the sound source library. Avoid using any voicebank if you do not understand the TOS.
炎上悪魔 may change or update the TOS at any point of time and is not liable for the User's non-compliance to the updated version of the TOS. By accepting these TOS you agree and represent that you understand and agree to the foregoing and to what is stated below.
The User agrees NOT to:
Publish any Content that is unlawful, harassing, threatening, harmful, tortuous, defamatory, libellous, abusive, violent, obscene, vulgar, invasive of another’s privacy, hateful, sexist, racially or ethnically offensive or otherwise discriminatory towards a party;
engage in any copyright infringement or other intellectual property infringement;
engage in any illegal, unlawful or any activity that would put the program, voicebanks or 炎上悪魔 highly susceptible to lawsuits or legal action;
use the voicebank an intent to hurt or harass another person.
PAYMENT
(If the vocals are put up for purchase in any way that is distributed by 炎上悪魔 or with 炎上悪魔's permission.)
炎上悪魔 denies all liability for any loss or failure of payment from the User. Only when the full amount is paid, the voicebanks is available to the User. The User is said to be given a non-transferable, non-exclusive license solely for personal use.
Any use in excess of that granted by the licence, in particular the re-licensing of the file, rendering it available in Internet or any file-sharing network or any other commercial use of the file is impermissible and license of the user will be terminated. 炎上悪魔 will not be liable for any temporary or permanent fault in the transfer of the data to the User’s server.
No refund will be given when the voicebanks are deleted from the User's system.
To obtain permission for using any characters and/or voicebanks in any type of commercial work, please contact 炎上悪魔 directly. Commercial use permission does not transfer to other works of the same creator(s) if these have not also been approved. Doujinshi's/Webtoons/Comic works that can be bought, but do not make profit and only charge to make up for production costs are exempt from needing permission. Works where all profits are donated to charity are not seen as commercial use and thus exempt from needing permission.
USE OF VOICEBANKS
The voicebanks, that consists of all required phonemes to operate in the vocal synthesizer programs and is fully functional. The User can edit, modify or delete the voicebank solely for personal use, and shall NOT redistribute, re-sell or circulate the it in any form, edited or intact. The User can use the voicebanks to act as character voice for a original song, covered song, talking in video or self-animated video.
CHARACTER TERMS
When publishing videos featuring the Vyro Virtual Singer's series' Vocal Synthesizer characters, please visibly provide the name of the character and the creator's name (炎上悪魔/EnjouAkuma) *Unless the character is voiced by a different person, then please specify that person too.* Please put those in the description(s) and/or credits section(s) of any published works.
18+ content is allowed to be created with characters that resemble as adults and have their age set as 18 or over.18+ art is not allowed for characters that resemble minors. Drawing older versions of said characters in 18+ art is only okay if they are clearly depicted as being an adult. Explicit 18+ content is not allowed to be of a violent nature. Rape, explicit gore, etc. are forbidden.
Permission to draw characters associated with other voicebanks (besides Vyro Virtual Singer's voicebanks), write stories featuring them, making them characters in games, etc. is not needed, as long as all Character and Character-specific rules and/or information are respected.
Claiming that one or more Vyro Virtual Singer's sexual orientation and or romantic partner is canon based on your depictions is not allowed and thus please refer to that as a headcanon unless the character actually states that.
Permission to roleplay as any Vyro Virtual Singer's character is not required. However, please stick to the Character and Character-specific rules and/or information.
DERIVATIVE CHARACTER|VOICE EDIT
Audio edits from existing audio materials like songs or voice acting renders that only change pitch or put filters over the audio, like Pitchloids, Nightcore, Chipmunk, etc. are not allowed. Please edit the pitch using UTAU's gender flag instead (g0 being the default value, g-100 the lowest and g100 the highest).
Derivative characters are allowed to be made, but are still subject to the Character and to Character-Specific rules and/or information, if these are applicable to the source character.
Derivative characters that are meant to resemble minors and/or are of minor age are not allowed to be depicted in 18+ situations.
Characters that look like small children, but are stated to be 500 years old would convey under this rule as it's not appropriate.
VOICEBANK TERMS
Selling any of the Vyro Virtual Singer's Vocal Synthesizing voicebanks or raw data samples is strictly forbidden unless given 炎上悪魔's consent.
The Vyro Virtual Singer's Vocal Synthesizing voicebanks are not allowed to be redistributed publicly without prior permission from their creator. Private distribution is allowed, provided the voicebank is unaltered from how it was downloaded originally.
Oto.ini configuration files are allowed to be altered or made from scratch and can be freely distributed, no consent needed, but please credit yourself.
The WAV files included in any of the Vyro Virtual Singer's Vocal Synthesizing voicebanks are not allowed to be publicly distributed or included in downloadable virtual instruments without prior permission of 炎上悪魔.
(This includes, but is not limited to: UTAU voicebanks, soundfonts, VST(i)s, sample packs, etc.)
Conversion of Vyro Virtual Singer's Vocal Synthesizing voicebanks WAV files to other sound formats, such as .AIFF, .MP3 and .OGG ect. is allowed, but only for personal use.
18+ audio content is allowed to be created only with voicebanks that resemble adults and have their age set as 18 or over. 18+ audio content is forbidden for voicebanks that are intended to resemble the voice of minors. When in doubt, please check the lyrics of the song and the voicebank in question for information on the age the voice is meant to resemble (Unless there is a specific voicebank for the minor-resembled character that has a 18+ age change, then use that voicebank.)
Voicebanks are allowed to be used for voice acting/talking purposes such as HANASU, COEIROINK, Coefont, Other open sourced talking synthesizer's (given consent by 炎上悪魔), audio dramas, game dialogue or voice sound effects, etc. Other rules still apply to this.
OTHER TERMS
Converting any Vyro Virtual Singer character to any other Vocal Synthesizer is permmited, but please notify 炎上悪魔 of doing this. 炎上悪魔 will not take responsibilty of the user converting the character to the desired Vocal Synthesizer and getting in trouble by doing so.
Making art of any Vyro Virtual Singer character is freely and openly okay to do , just credit 炎上悪魔 for the character. Modifying any Vyro Virtual Singer character design is fine, but make sure it still looks like the desired character. Heavily modified changes of said character are forbbiden, but minor changes are fine. Changing any of the Vyro Virtual Singer character's race (furry, vampire, elf, ect...) are not permmited.
The making of a 3D model of for any software (such as: Blender, Unity, Vroid, MMD) are not permmited, but do give the correct credits and notify 炎上悪魔.
